This Privacy Policy explains how NOICTSY LLC, doing business as Modern Woodsman ("Modern Woodsman," "we," "us," or "our"), collects, uses, discloses, and retains information when you use our website, applications, and related services (the "Service"). By using the Service, you agree to this Privacy Policy. This Privacy Policy is incorporated into our Terms of Service.
1. Who We Are and How to Contact Us

2. Information We Collect
We collect information in the following general categories:
- Contact and account information, such as your name, email address, authentication credentials, and, if you sign in through a third-party single sign-on provider, limited account identifiers we receive from that provider.
- Billing information, such as subscription and transaction records maintained through our third-party payment processor.
- Content and related information that you create, upload, or connect when using the Service, together with information our systems generate from that content. This includes information collected from third-party services you connect to the Service on your behalf.
- Information collected automatically when you use the Service, such as device information, diagnostic information, service-usage information, cookies and similar technologies, and information collected through our analytics providers. See Cookies below.
- Environmental information we obtain from public sources to enrich content in the Service. This information is not collected from you.
Sensitive personal information. Some information we collect is treated as "sensitive" under certain state laws — in particular, precise geolocation associated with content you create or connect through the Service. We collect and use precise geolocation only to provide the Service's core features and not for advertising. See "Your Privacy Rights" for how to limit the use of sensitive personal information.
Images that may contain people. The Service is designed to detect and analyze wildlife. Images you provide may capture individuals other than the account holder (for example, invited guests, neighbors, or trespassers). Our systems may detect the presence of non-deer subjects, including humans, at a class level only. We do not perform facial recognition, extract face geometry, or generate biometric identifiers of any person. You are responsible for having the right to upload images and for not submitting images of identifiable people without a lawful basis, as described in the Terms of Service.
3. How We Use Information
We use information to:
- provide, personalize, and improve the Service;
- process payments and manage your account and subscription;
- communicate with you, including transactional messages and, where permitted, marketing communications;
- promote the safety, security, and integrity of the Service and prevent fraud and misuse;
- conduct research and develop new features; and
- comply with legal obligations and enforce our Terms.
4. AI Processing and Model Improvement
We use third-party providers and our own systems to process your content and generate the outputs the Service provides. Information handled by third-party providers is subject to their own terms and privacy practices, which we do not control.
We may use information from your use of the Service to improve our systems, including corrections you or our team make and de-identified or aggregated information. Where we use de-identified or aggregated information, we maintain it in that form and do not attempt to re-identify it. We do not share your identified information externally for training purposes.
5. How We Disclose Information
We do not sell your personal information, and we do not "share" it for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act (CCPA/CPRA).
We disclose information to:
- Vendors and service providers who process information on our behalf to support the Service, including providers of hosting and cloud infrastructure, payment processing, communications and messaging, analytics, customer support, and other services that support the Service's operation.
- Legal and safety recipients when required by law or to protect rights, safety, or the integrity of the Service.
- Successors in connection with a merger, acquisition, financing, or sale of assets.
6. Cookies and Opt-Out Preference Signals
We use cookies and similar technologies for authentication, preferences, and analytics. You can control cookies through your browser settings. We honor recognized opt-out preference signals, such as the Global Privacy Control (GPC), where required by law.
7. Communications
We send transactional messages and, where permitted, product updates and marketing communications through email and push notifications. You can opt out of marketing communications through the unsubscribe link or your account preferences. Push notifications are configured or disabled in the app and at the operating-system level.
8. Retention
We retain information for as long as reasonably necessary to provide the Service, meet legal obligations, resolve disputes, prevent fraud and abuse, and support other legitimate business purposes. When determining retention periods, we consider the nature and sensitivity of the information, the purposes for which we process it, the potential risk from unauthorized use, and applicable legal, tax, and regulatory requirements.
Where we retain information derived from your content after the underlying content is deleted, the derived information may no longer be linked to the original content.
9. Account Deletion
You can delete your account through your profile settings. When you do, we delete your account and associated personal information from our active systems. Some information may be retained where necessary for legal, security, operational, or fraud-prevention purposes, or in de-identified form. 10. Your Privacy Rights
All users. You can access and update much of your information through the Service, correct information about you where available, opt out of marketing communications and push notifications, and delete your account as described above.
U.S. state privacy rights (including California). Depending on your state of residence, you may have rights to know, access, delete, correct, and obtain a portable copy of your personal information, and to opt out of "sale," "sharing," and certain targeted advertising and profiling. We do not sell or share personal information as those terms are defined under the CCPA/CPRA. To exercise your rights, contact legal@modernwoodsman.ai.
Right to limit sensitive personal information. California residents may request that we limit our use of sensitive personal information, including precise geolocation, to what is necessary to provide the Service. Because we already use precise geolocation only to provide core features and not for advertising or profiling, we do not use or disclose it for any purpose that would require a separate limitation right. You may still contact us with any request.
Verification and how we respond. We will take reasonable steps to verify your identity before responding, which may require you to confirm information associated with your account. We will respond within the timeframes required by law (for California, generally 45 days, extendable by an additional 45 days). You have the right not to receive discriminatory treatment for exercising your rights.
Right to appeal. If we decline your request, you may appeal by replying to our decision or emailing legal@modernwoodsman.ai with the subject line "Privacy Appeal." We will respond within the period required by applicable law and, where required, tell you how to contact your state attorney general if you remain unsatisfied.
Automated processing. The Service uses automated processing to analyze the content you provide. This processing is directed at analyzing wildlife and land, not at evaluating individuals, and does not produce legal or similarly significant effects concerning any person.
11. Children and Minors
The Service is intended for users 16 and older. We do not knowingly collect personal information from anyone under 13, and we do not direct the Service to children under 16. If we learn we have collected information from a child under 13, we will delete it.
For users under 18, we do not knowingly sell or "share" the personal information of any user we know to be under 18, and we do not use their information for targeted advertising, in each case without the opt-in consent required by applicable law. Where a user is between 16 and the age of majority, we rely on the parental review and consent described in the Terms of Service.
12. Data Security and Breach Notification
We maintain administrative, technical, and organizational safeguards designed to protect your information. Access to production data is limited to authorized personnel. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
If we become aware of a security incident affecting your personal information, we will notify you and any regulators as, and within the timeframes, required by applicable law.
13. U.S. Data Storage
The Service is directed to users in the United States. Our providers store and process data on cloud infrastructure located in the United States. By using the Service, you understand your information will be processed in the United States.
14. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version with a new effective date and, where required, provide additional notice. Your continued use after the effective date constitutes acceptance.
